IMPORTANT LEGAL NOTICE
By accessing, registering for, or using the Unity Global Care platform in any manner — including creating a profile, searching for jobs, applying for a position, uploading documents, or participating in AI-assisted phone or video interviews — you agree to be legally bound by these Terms. If you do not agree, you must immediately stop using the Platform and not create an account.

1. Acceptance of Terms
Using the Platform, or clicking "I Agree"/"Accept"/"Submit," constitutes your binding acceptance of these Terms. You must be at least 18 years old, have legal capacity to contract, and provide accurate information. Your electronic acceptance is a valid signature under the E-SIGN Act and Delaware UETA.

2. What This Platform Is
Unity Global Care is a technology-based applicant tracking system ("ATS") that connects Candidates with Client home care and home health employers. It is not a staffing agency, employment agency, or recruiter, and it does not create an employment relationship with Candidates.

3. Services Available to Candidates
Through the Platform you may create a profile, search and apply to job listings, upload documents and credentials, participate in AI-assisted phone and video interviews, receive AI-generated resume/interview scoring, and get status notifications. These AI tools are informational and organizational only — they do not make hiring decisions.

4. No Involvement in Hiring Decisions
Unity Global Care has no role in any hiring decision. All decisions to interview, advance, reject, or hire a Candidate are made solely by the Client employer. Any grievance about a hiring decision must be directed to that employer, not Unity Global Care. Clients are independently responsible for complying with employment laws (Title VII, ADA, ADEA, Equal Pay Act, FCRA, GINA, and applicable state/local laws).

5. Eligibility and Accounts
You must be 18+, legally authorized to work (or eligible for the positions you apply to), and not previously banned from the Platform. You are responsible for your account security and credentials, may keep only one active account, and may not transfer your account to anyone else.

6. Prohibited Conduct
You may not: misrepresent your identity or qualifications; submit forged or falsified documents; have someone else take your interview; manipulate or cheat AI evaluation systems; access other accounts, Client data, or restricted systems without authorization; introduce malware or disrupt the Platform; reverse-engineer the Platform; scrape or harvest data; use the Platform for unauthorized commercial purposes; harass any User, Client, or Unity Global Care personnel; or circumvent security measures. Violations may result in account suspension or termination, notice to Client employers, law enforcement referral, and civil or criminal legal action.

7. AI-Assisted Interviews and Data Processing
By participating in an AI-assisted interview or assessment, you consent to the use of AI, machine learning, natural language processing, and (where permitted) facial/speech/sentiment analysis to evaluate your resume and interview performance, and to the storage of those results. AI tools are not infallible, may contain errors or bias, and their scores do not determine hiring outcomes. Where required, Unity Global Care aims to comply with applicable AI employment laws (e.g., Illinois AI Video Interview Act, Maryland HB 1202, NYC Local Law 144).

8. Document Uploads
You are solely responsible for ensuring anything you upload is accurate, authentic, legally shareable, and free of malicious code. Uploading content grants Unity Global Care a license to use it to operate the Platform, share it with Clients you've applied to, and support AI evaluation. Content is not stored indefinitely and may be purged per Unity Global Care's retention policies.

9. Recording and Monitoring Consent
By using the Platform for any phone or video interview, you expressly consent to audio/video recording, monitoring, transcription, and storage of that communication, and to Client employers accessing those recordings/transcripts to evaluate your candidacy. You have no expectation of privacy in Platform communications, including in states with two-party recording consent laws.

10. Privacy Policy and Data Use
Our Privacy Policy (homecareinterview.com/privacy-policy) is incorporated into these Terms. You consent to Unity Global Care collecting, storing, and sharing your profile, application materials, documents, interview recordings/transcripts, and AI-generated scores with Client employers you've applied to. Unity Global Care aims to comply with applicable privacy laws (CCPA, CPRA, and other state statutes) and retains data as required by law or operational need.

11. Intellectual Property
The Platform, its software, algorithms, AI systems, and branding are the exclusive property of Unity Global Care. You get a limited, personal, non-transferable license to use it for your own job search — not to copy, scrape, resell, or create derivative works from it. Feedback you provide may be used by Unity Global Care without compensation or attribution.

12. No Warranties
The Platform is provided "as is" and "as available," with no guarantee of uninterrupted or error-free operation, and no guarantee that using it will result in an interview, job offer, or any particular employment outcome.

13. Limitation of Liability
To the fullest extent allowed by law, Unity Global Care is not liable for indirect, incidental, or consequential damages, for hiring decisions made by Clients, or for errors in AI-generated scores. Total aggregate liability is capped at the greater of $50 or the amount you paid Unity Global Care in the prior 12 months (the Platform is free for Candidates).

14. Indemnification
You agree to indemnify and hold harmless Unity Global Care and its officers, employees, and affiliates from claims arising out of your use of the Platform, your breach of these Terms, content you submit, or your violation of any law or third-party right. This obligation survives termination of your account.

15. Arbitration Agreement — Please Read Carefully
Except for the exceptions below, disputes with Unity Global Care are resolved through binding individual arbitration (AAA Consumer Rules, or JAMS if AAA is unavailable), seated in Delaware, rather than in court. You and Unity Global Care each waive the right to a jury trial and to bring or join a class action. Each side pays 50% of arbitration fees, with a hardship exception available. Before filing, you must send written notice and negotiate in good faith for 60 days. Claims must be filed within 1 year. You may opt out of arbitration by written notice within 30 days of creating your account. Exceptions to arbitration: emergency injunctive relief for Platform misuse or IP infringement, enforcement of an arbitration award, non-arbitrable claims, and small claims court.

16. Unity Global Care's Right to Pursue Legal Action
Unity Global Care may pursue legal remedies — including injunctions, damages, and criminal referral — against fraud, document or identity fraud, interview fraud, unauthorized system access, IP infringement, data scraping, platform interference, defamation, or harassment.

17. Termination
Unity Global Care may suspend or terminate your account at any time for violations of these Terms or other legitimate reasons, without prior notice or liability. You may close your account at any time. Provisions that by nature should survive (IP, warranties, liability, indemnification, arbitration, governing law) continue to apply after termination.

18. Changes to These Terms
Unity Global Care may modify these Terms at any time by posting an updated version with a new "Last Updated" date, and may also notify you by email or in-Platform notice. Continuing to use the Platform after a change means you accept the updated Terms.

19. Governing Law
These Terms are governed by Delaware law, and non-arbitrable disputes are subject to the exclusive jurisdiction of Delaware state and federal courts. The Federal Arbitration Act governs the arbitration provisions.

20. Severability
If any provision is found invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the rest of these Terms remain in effect.

21. Entire Agreement
These Terms, together with the Privacy Policy, are the entire agreement between you and Unity Global Care regarding the Platform, superseding any prior discussions. Headings are for convenience only, and no oral statement can modify these Terms.

By using the Platform, you confirm that you've read and understood these Terms, that you are at least 18, that you accept the binding arbitration, class-action waiver, and jury-trial waiver in Section 15, that you consent to interview recording and AI-based evaluation, and that you understand Unity Global Care has no role in any Client's hiring decision.
